The Terms and Conditions of use of the avrainstitute.ro website detailed below establish the conditions under which a person can visit, access and use this Website.

Accessing this page and continuing to view the Site represents your agreement to fully comply with the clauses detailed in the Terms and Conditions, thus establishing contractual relations between the user and SC AVRA ESTETIC SRL regarding this Site.

Art. 2. Protection of personal data and privacy

By accessing the Site and/or filling in the forms on the Site or disclosing personal data through any other method provided on the Site, each user expresses their express and unequivocal consent for SC AVRA ESTETIC SRL to access the data his personal data, including those stored on social networks (such as Facebook, Twitter, etc.), to send emails to the user, to post on the Wall, to access the profile information on Facebook or another social network, as well as to store and use.

According to the requirements of Law no. 677/2001 for the protection of individuals regarding the processing of personal data and the free circulation of these data, amended and supplemented, and of Law no. 506/2004 regarding the processing of personal data and the protection of private life in the electronic communications sector, SC AVRA ESTETIC SRL have the obligation to manage in safe conditions and only for the specified purposes, the personal data that they give us provides the user about the user, a member of the user’s family or another person. The purpose of data collection is “advertising, marketing and advertising” and “electronic communication services”, as well as the use of data for invoicing the ordered products.

According to the provisions of art. 20 paragraph (1) of Law 677/2001 for the protection of individuals regarding the processing of personal data and the free circulation of such data, amended and supplemented, SC AVRA ESTETIC SRL have the obligation to apply the measures adequate technical and organizational measures to protect personal data against accidental or illegal destruction, loss, modification, disclosure or unauthorized access, as well as against any other form of illegal processing.

The personal data that we process are intended for use by SC AVRA ESTETIC SRL and will only be communicated to contractual partners with whom there are or will be signed confidentiality contracts for the processing of personal data. At the end of data processing operations for marketing and advertising purposes, SC AVRA ESTETIC SRL will not transfer these data to another operator. The communication of this data to the contractual partners is carried out only for the purpose of informing them about the provision of marketing and advertising services and the display of the user-beneficiaries of the products and/or services sold through the site. SC AVRA ESTETIC SRL is not responsible for any unauthorized use of personal data by its partners.

According to Law 667/2001, users have the following rights: the right of access, the right to intervene on the data, the right not to be subject to an individual decision and the right to go to court. At the same time, you have the right to object to the processing of personal data concerning you and to request the deletion of the data. To exercise these rights, users must send a written, dated and signed request to SC AVRA ESTETIC SRL at the headquarters in Str Occidentului, no. 3, et 1, office 11, sect 1, Bucharest. Also, the user has the right to go to court.

If some data provided by the user to SC AVRA ESTETIC SRL is incorrect, the user undertakes to immediately inform SC AVRA ESTETIC SRL.

Art. 3 Ownership of the Site

The site as a whole, as well as all its component elements: site graphics, design, banners, computer programs, all materials posted and/or published by SC AVRA ESTETIC SRL (such as under the title for example: audio recordings, audiovisual recordings, visual recordings, photographs, graphic elements, articles, brands, names, images) are protected by intellectual property legislation (copyrights, respectively industrial property rights) in Romania and in any other territory of the the world, regardless of whether this is expressly mentioned or not.

The reproduction, distribution and any other type of unauthorized use of the Site and/or its component elements or the information displayed on the Site is prohibited and is punishable according to civil, contraventional and criminal law.
SC AVRA ESTETIC SRL may at any time change the content of the Site, the structure, the type of information provided, may suspend or interrupt the provision of information, may suspend or interrupt the operation of the Site, may limit access to certain information, may limit the access of certain IPs, and/or may bring any other kind of changes to the Site, without the need for a prior notification to be addressed to the user and without the need for the user’s consent.

Art. 4 Users’ rights

Users have the right to download and reproduce the content on the Site, only for personal non-commercial use.

The retrieval of information by other sites can be done, free of charge, only within the limit of 500 semen, but without exceeding half of the content in question, with the obligation of the user to cite the source which will be accompanied by a link to the Site .

It is expressly prohibited for the user to:

  2. Reproduce, multiply, copy, distribute or use in any way, in whole or in part, the Website, for any commercial purpose;

The information or materials that the Site promotes do not attract the responsibility in any form of SC AVRA ESTETIC SRL. Users have the opportunity and the obligation to check other sources to establish the accuracy of the information.

The users agree to exempt from liability and not to sue SC AVRA ESTETIC SRL in court regarding any claim raised by a third party, resulting from the use of the Site, as well as regarding any loss (direct, indirect or of another nature), costs, actions, lawsuits, claims, damages, expenses (including court costs) or other liabilities, for damages suffered in any way or caused directly by SC AVRA ESTETIC SRL</ strong> as a result of the violation or disregard by the user of these Terms and Conditions.

The site and the goods, services, third-party applications, third-party content and any other type of information and content posted on the Site are offered to the user “as is”, without any liability on the part of SC AVRA ESTETIC SRL.< /strong>

This Site may contain sections where the user can post information, materials, including text, images, photos, audio recordings, audiovisual recordings, visual recordings, etc.

The user guarantees SC AVRA ESTETIC SRL that the materials he will display are his property, are not infected and not coded, and SC AVRA ESTETIC SRL (including its affiliates) is authorized to use them, free of charge, non-exclusively, unlimited in time, throughout the world, being able to use them in any of the ways provided by art. 12, art. 13 and art. 68 of Law no. 8/1996, without the user being able to invoke the violation of a moral or patrimonial right. Also, SC AVRA ESTETIC SRL is authorized to use the user’s name/designation/brand and/or the user’s personal data necessary to associate the display with the user, as well as to use your display for the purpose of promotion and business of the Site.

The user guarantees SC AVRA ESTETIC SRL that, in relation to the materials he will display, there is and will not be any action, demand or any other kind of claim from third parties resulting from:

  1. unauthorized use of materials by the user (photos, artistic performances or other material bearing copyright and/or rights related to copyright, confidential information), as well as through the displayed content, the user:</li >
  2. does not violate human rights, including the right to one’s own image or to a person’s private life;
  3. does not affect the honor, reputation, human dignity of a person;
  4. does not promote discrimination based on race, gender, sexual orientation, religion, ethnicity, disability;
  5. does not promote explicit sexuality, sexual or violent language;
  6. does not violate the right to the trademark or any other industrial property right of a person;
  7. does not constitute self-promotion or unauthorized advertising;
  8. does not commit an act of unfair competition;
  9. do not transmit viruses or harmful or invasive codes/programs, monitoring the use of any hardware, software or equipment.

In case of failure to comply with the above guarantees, the user assumes full responsibility and expressly exempts SC AVRA ESTETIC SRL from any type of responsibility resulting from the user’s interaction with the Site. SC AVRA ESTETIC SRL renounces such behaviors.

The user acknowledges that R SC AVRA ESTETIC SRL has the right (but not the obligation) to delete any material displayed by the user that it considers, at its free discretion, to be in contradiction with the Terms and Conditions or with the conduct policy of SC AVRA ESTETIC SRL in the online environment.
SC AVRA ESTETIC SRL is not responsible for computer viruses of the user’s system, for unauthorized access to its own system or to the user’s system, for the interruption of the connection or the provision of Internet services, for the use of materials displayed by the user by other websites -s, including through links or references.

Art. 6. Contests

Users who participate in contests organized by SC AVRA ESTETIC SRL are obliged to fully comply with these Terms and Conditions, as well as the regulations imposed on each contest.
Changing personal data during the competition, changing identity, giving or selling prizes to third parties, holding multiple accounts in order to increase the chances of winning are prohibited.
Any violation of these Terms or the regulation leads to the disqualification of the competitor, in some cases to the blocking of access to participation in future contests.

Art. 7 Disputes

Any disputes arising between SC AVRA ESTETIC SRL and users will be resolved amicably or, if this is not possible, the disputes will be settled by the Bucharest courts.

This Regulation was drafted in compliance with the provisions of Law 365/2002 on electronic commerce, Law 677/2011 for the protection of individuals with regard to the processing of personal data and the free movement of such data and Law 650/2002 for the approval of Government Ordinance 99/2000 regarding the sale of products and services on the market.
